By accessing, downloading, or otherwise utilizing any software ("Cargo") distributed by BLACKFLAG.TECH ("The Network"), the Operator ("You") acknowledges full understanding of and agreement to all terms, conditions, and articles contained within this Letter of Marque.

This agreement is entered into voluntarily and constitutes a binding contract between You and BLACKFLAG.TECH upon the moment of acquisition. If You do not agree to these terms, You must immediately cease all use of The Network and its Cargo.

All Cargo distributed by The Network is licensed — not sold — to the Operator under a Single-Operator License. This license is non-transferable, non-sublicensable, and non-exclusive. The Operator may install and use the Cargo on personal devices under their direct control.

Redistribution, resale, reverse engineering, decompilation, or modification of any Cargo without explicit written authorization from BLACKFLAG.TECH constitutes a material breach of this agreement and may result in legal action.

ALL CARGO IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

BLACKFLAG.TECH MAKES NO REPRESENTATION THAT THE CARGO WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE FROM VULNERABILITIES. THE OPERATOR ASSUMES ALL RISK ASSOCIATED WITH USE OF THE CARGO.

IN NO EVENT SHALL BLACKFLAG.TECH, ITS OFFICERS, DIRECTORS, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF, OR INABILITY TO USE, ANY CARGO, EVEN IF BLACKFLAG.TECH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

The Operator's sole remedy for dissatisfaction with the Cargo is to cease use. Maximum liability is limited to the amount paid by the Operator for the specific Cargo in question.

The Operator covenants to use all Cargo in strict compliance with all applicable local, national, and international laws and regulations. The Operator bears sole and exclusive responsibility for determining the legal permissibility of any use of The Network's Cargo within their jurisdiction.

BLACKFLAG.TECH expressly prohibits using any Cargo for: unauthorized access to computer systems, interception of communications, illegal surveillance, circumvention of digital rights management on third-party systems, or any other activity that violates applicable law.

USE OF ANY CARGO FOR CRIMINAL PURPOSES IS STRICTLY AND ABSOLUTELY PROHIBITED. This includes but is not limited to: any activity constituting a criminal offence under applicable law; use in furtherance of fraud, extortion, harassment, stalking, or coercion; deployment against individuals or organizations without lawful authorization; use in connection with any enterprise engaged in criminal activity. BLACKFLAG.TECH tools are instruments of operational security and digital sovereignty — they are not, under any circumstances, to be used as instruments of crime. Sole and exclusive legal liability for any criminal misuse rests entirely with the Operator. BLACKFLAG.TECH reserves all rights to cooperate fully with lawful legal process, law enforcement requests, and judicial proceedings arising from Operator conduct.

BLACKFLAG.TECH collects only the minimum data necessary to process transactions and deliver Cargo: email address and payment information (processed by Stripe; not retained by The Network). No usage data, telemetry, or behavioral analytics are collected.

The Network does not sell, rent, or share Operator data with third parties except as required by law or to process payments. All data is transmitted over encrypted channels.

Due to the instantly-deliverable, digital nature of all Cargo, all sales are final. BLACKFLAG.TECH does not offer refunds once the Cargo has been delivered. If the Cargo is demonstrably defective or non-functional, contact The Network within 7 days of acquisition for resolution.

This Letter of Marque shall be governed by and construed in accordance with applicable law. Any dispute arising under this agreement shall be resolved through binding arbitration where permitted by law. The Operator waives any right to participate in a class-action lawsuit against BLACKFLAG.TECH.
